Welcome to Proven Path. These Terms of Service ("Terms") govern your use of proven-path-2.myshopify.com (the "Site") and the purchase of products from [LEGAL_ENTITY_NAME] ("Proven Path," "we," "us," or "our"). By accessing the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site.

1. Eligibility

You must be at least 18 years old to purchase products or create an account. By placing an order, you represent that you are 18 or older and legally able to enter into this agreement.

Some features of the Site require you to create an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for all activity that occurs under your account and for keeping your password secure. Notify us immediately at shop@leviri.com if you suspect unauthorized access.

3. Products and pricing

We make every effort to display products, descriptions, and prices accurately. However, we do not warrant that product descriptions, images, pricing, or other Site content is error-free. If a product is listed at an incorrect price due to a typographical or pricing error, we reserve the right to cancel any order placed at the incorrect price, whether or not the order has been confirmed and your payment processed.

Prices are listed in U.S. dollars and may change at any time without notice. All orders are subject to product availability.

4. Orders and acceptance

When you place an order, you're making an offer to purchase. We reserve the right to accept or decline any order for any reason, including but not limited to product availability, errors in product or pricing information, suspected fraud, or unauthorized activity.

If we cancel an order after payment has been processed, we'll issue a full refund to your original payment method.

5. Subscriptions

Subscription purchases are governed by our Subscription Terms, which are incorporated into these Terms by reference.

6. Shipping and returns

Shipping is governed by our Shipping Policy. Returns and refunds are governed by our Return & Refund Policy. Both documents are incorporated into these Terms by reference.

7. Health disclaimer

Proven Path products are dietary supplements, not drugs. They are not intended to diagnose, treat, cure, or prevent any disease. Statements about our products have not been evaluated by the U.S. Food and Drug Administration.

You should consult with a qualified healthcare provider before using any Proven Path product, especially if you are pregnant, nursing, taking medications (including methotrexate, anti-seizure medications, or antidepressants), or have any medical condition. 8. User conduct

When using the Site, you agree not to:

  • Violate any law or regulation.
  • Infringe on any third party's intellectual property, privacy, or other rights.

10. User-generated content

When you post reviews, comments, testimonials, photos, videos, or other content ("User Content") on the Site or through our social channels, you grant Kupczyk Ventures LLC a non-exclusive, royalty-free, perpetual, worldwide license to use, modify, reproduce, distribute, and display that content in connection with our business, including in marketing materials.

You represent that any User Content you submit is accurate, is your original work, does not infringe on any third party's rights, and complies with all applicable laws.

We reserve the right to remove any User Content for any reason at our discretion.

11. Disclaimers

The Site and all products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Kupczyk Ventures LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

Individual results from our products will vary. Testimonials reflect the experiences of specific individuals and are not guarantees of any particular outcome.

12. Limitation of liability

To the fullest extent permitted by law, Kupczyk Ventures LLC, its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our products, including lost profits, lost data, or personal injury, even if we've been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of the Site will not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

Some jurisdictions don't allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Kupczyk Ventures LLC, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Site or products, or your violation of any third party's rights.

14. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws principles. Any dispute arising from these Terms or your use of the Site will be resolved exclusively in the state or federal courts located in Sheridan, and you consent to the personal jurisdiction of those courts.

Informal resolution first. Before filing a claim, you agree to contact us at shop@leviri.com to attempt to resolve the dispute informally. Most issues can be resolved quickly this way.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll notify you by updating the "Last updated" date at the top of this page and, where appropriate, by email. Your continued use of the Site after any changes means you accept the updated Terms.

16. Termination

We may suspend or terminate your access to the Site or your account at any time, for any reason, without notice, including if we believe you've violated these Terms.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

18. Entire agreement

These Terms, together with our Privacy Policy, Shipping Policy, Return & Refund Policy, Subscription Terms, and Medical Disclaimer, constitute the entire agreement between you and Proven Path regarding your use of the Site and our products.
